Terms and Conditions (GTC)

Scope

These terms and conditions contain the exclusive terms and conditions applicable between you and us, Christian von Eicke GmbH, Seestraße 11, 16562 Hohen Neuendorf.
"Militaria-Berlin" and "von Eicke Auctions" are projects of Christian von Eicke GmbH. Any changes to these terms and conditions must be made in writing.

Product selection

  1. You have the opportunity to select and order items on our website.
  2. You can select the items you want on the website. These will be collected in a virtual shopping cart, and at the end of your purchase, you will receive a summary of all items and the total price.
  3. Before completing your order, we give you the opportunity to check the order for accuracy, completeness and, in particular, price and quantity, and to correct it if necessary.

Conclusion of contract

The presentation of our goods does not constitute a binding offer on our part. Only your order of the goods constitutes a binding offer according to Section 145 of the German Civil Code (BGB). If your offer is accepted, we will send you an invoice by email.

Terms of payment

  1. The purchase price is due immediately upon conclusion of the contract. Payment for the goods is usually made in advance or cash on delivery.
  2. All prices are to be understood as end-customer prices. Items without VAT are subject to differential taxation according to Section 25a of the German Value Added Tax Act (UStG). Furthermore, shipments to third countries are considered tax-free export deliveries according to Section 4 No. 1a of the German Value Added Tax Act (UStG). Prices for items not subject to differential taxation are shown including statutory VAT.
  3. All prices are quoted in €, British pounds and US dollars.
  4. For items paid for via PayPal, only the address stored with PayPal is relevant. Please note this!

Delivery

  1. Shipping costs are to be borne by the buyer. They will be listed separately on the invoice.
  2. Please note that customs duties or taxes may be charged when shipping abroad. These are the responsibility of the buyer.

Retention of title
The goods remain the property of Christian von Eicke GmbH until full payment has been made.

warranty

  1. All pieces we offer are contemporary originals unless expressly stated otherwise.
  2. All descriptions are provided to the best of our knowledge and belief. Our images are part of the description; they have not been electronically enhanced.
  3. We grant an unlimited right of return for originality.
  4. If there is a defect that is subject to warranty, you are entitled, within the framework of the statutory provisions, to demand subsequent performance, to withdraw from the contract or to reduce the purchase price.

Right to cancel


You have the right to withdraw from this contract within four weeks without giving any reason.

The cancellation period shall be four weeks from the day on which you or a third party other than the carrier designated by you takes possession of the goods.

To exercise your right of withdrawal, you must inform us (Christian von Eicke GmbH, Seestraße 11, 16562 Hohen Neuendorf, E-Mail: info@militaria-berlin.de ) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or e-mail).

In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of withdrawal

If you cancel this contract, we will refund all payments that we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the date on which we received notification of your cancellation of this contract. For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund. We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us immediately and in any event no later than fourteen days from the date on which you notify us of the cancellation of this contract. This period shall be deemed to have been observed if you dispatch the goods before the expiry of the period of fourteen days.

You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling you that is not necessary to check the nature, properties and functionality of the goods.

End of cancellation terms  

Legal provisions, in particular §§ 86,86a StGB

  1. We expressly point out that any contemporary and military historical goods requested and delivered by us, in particular those from the period 1933 – 1945, are only delivered for the purposes of civic education, the defense against unconstitutional and anti-constitutional efforts, scientific and art historical research, the education and reporting on current events or military historical and uniform research and thus §§ 86,86a StGB as well as other applicable law.
  2. By placing your order, you as the buyer undertake to acquire these objects only for historical and scientific purposes for the reasons stated in paragraph 1 and not to use them in any way for propaganda purposes in the sense of §§ 86,86a StGB or in any other criminal or unconstitutional manner. Orders will only be accepted under this condition.
  3. The buyer confirms that he is of legal age and has full legal capacity.
  4. Cutting, stabbing and thrusting weapons are only sold in compliance with legal regulations.
  5. When ordering from abroad, the buyer must observe the national legal regulations.

Privacy Policy

  1. We use the data you provide in accordance with the provisions of German data protection law.
  2. Your personal data will be used exclusively to process the contracts concluded between you and us, for example, to deliver goods to the address you provided. Your data will not be used for any other purposes, in particular, your data will not be shared with third parties.

Final provisions

  1. Should individual provisions of this agreement be invalid or conflict with statutory provisions, the remainder of the agreement shall remain unaffected. The parties shall replace the invalid provision with a provision that most closely approximates the meaning and purpose of the invalid provision in a legally effective manner. This provision shall also apply to any gaps in the agreement.
  2. Place of jurisdiction is Oranienburg / Federal Republic of Germany.
  3. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
